Terms and conditions & privacy

1. Scope and contracting parties

These terms and conditions apply to all business relations between MALIX-Publisher and their customers about physical products (for example books, CD’s, merchandise) and digital products (for example eBooks, audio books) and the services of all provided channels (for example web shop, applications). The Terms and conditions apply to the current version at the time of the conclusion of contract.

2. Occurrence of contract

The presentation of the MALIX-Publisher product range does not represent a closing of a purchase agreement with the costumer. It is non-binding. The costumer submits a binding offer and purchase agreement by ordering at the web shop or via another way. The costumer receives a confirmation of the order via e-mail, which is not an acceptance of the offer, but informs the customer that his/her/their purchase was received by MALIX-Publisher.

If MALIX-Publisher can not accept the order, the customer will be informed through another e-mail about the non-availability or rather the rejection of the order.

If items are temporary out of stock, they will be reserved for the customer, the order remains. Possible mistakes at the website, in terms of the information about the range, will be pointed out and corrected for the costumer. MALIX-Publisher is entitled to deliver orders partially at any time. If delays in delivery happen, the customer will be informed instantly.

3. Price, maturity, payment

Price fluctuations are possible. Relevant is the date of the statement of the items’ price. MALIX-Publisher only accepts the types of payment shown on the website. Purchase price and shipping costs are payed when purchasing an item.

4. Liability

All cases of breach of contract and legal consequences as well as the claims of the customer, no matter the legal ground, are regulated in this disclaimer. The costumer has no right for compensation claim if the product itself is not damaged. This applies to the personal liability for compensation for our employees, staff members, representatives as well. A liability claim that surpasses the price and value of the order is excluded.

5. Privacy

MALIX-Publisher obligates to treat the personal data of their costumers according to the Swiss data protection law. The protection of your privacy while processing your personal data and orders are important to us. Your data will only be saved and used to process your issues. Your data will only be used for the fallowing purposes:

to process your order and/or issue (purchase, questions)
to inform you about new products

Your data will be treated strictly confidential and will not be handed to third parties.

6. Right of withdrawal

Already delivered items can not be refunded. The costumer can contact MALIX-Publisher within 14 days if deliveries are incorrect or contain defective items. Afterwards the right of withdrawal expires. The right of withdrawal does not include items which are not meant to be send back (for example eBooks, audio books, downloads, merchandise etc.).

7. Retention of title

Until the payment is completed, the items are property of MALIX-Publisher.

8. Import of goods - abroad

Deliveries outside of Switzerland can be export restricted and import charges and taxes maybe occur, which must be paid by the costumer. The costumer is responsible for the payment of the necessary duties, taxes and fees.

9. Return costs in case of withdrawal

If the costumer makes use of his/her/their right of withdrawal, the costumer has to bear the return costs.

10. Governing Law and Jurisdiction

These terms and conditions are to be construed in accordance with the laws of Switzerland, and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Swiss court. The provisions of Swiss law apply as well, when the order is placed from and/or delivered to a foreign country. The place of jurisdiction is Winterthur, Switzerland.

11. Modifications of these Terms and conditions

We reserve the right to change our terms and conditions if necessary. Please make sure you’re presented with the newest version. If fundamental changes occur, we will announce them on our website.
